Revised MTCS document LG 3/2011 regarding issuance of PEFC Logo usage licenses replaces LG 2/2009

MTCC wishes to inform all the PEFC certificate holders and notified certification bodies that the MTCC Board of Trustees at its 49th meeting on 6 December 2011 has adopted the revised document dealing with application to use the PEFC Logo under the MTCS, entitled Issuance of PEFC Logo Usage Licenses by MTCC (LG 3/2011).

The revised document LG 3/2011 dated 6 December 2011 replaces the earlier document entitled Issuance of PEFC Logo Usage Licenses by MTCC (LG 2/2009) dated 3 September 2009, which is currently being used under the MTCS.  The main changes in the LG 3/2011 are to take into account the use of the new PEFC document PEFC ST 2001:2008 PEFC Logo Use Rules – Requirements Second Edition, as well as the change to paragraph 5 in the Logo Usage License Agreement (Appendix D) dealing with Misuse of Logo and Penalties.

Please take note that the LG 2/2009 will be withdrawn with effect from 26 November 2012.  PEFC certificate holders and CBs are advised to take note of this revision and in doing so, take the necessary actions to accommodate and abide with this change.

1.   Holders of PEFC Certificate for Chain of Custody

  • Kindly take note that the LG 3/2011 is applicable only to the CoC certificate holders that have been certified against the new CoC standard PEFC ST 2002:2010. This means that certificate holders certified against the PEFC ST 2002:2010 will have to use the LG 3/2011 to apply for the PEFC Logo Usage Licence from MTCC.
  • Certificate holders currently certified against the previous CoC standard PEFC
    Annex 4 will continue to use the LG 2/2009 to apply for the PEFC Logo Usage Licence from MTCC.
  • Existing PEFC Logo licence holders who have yet to be awarded a new certificate against the PEFC ST 2002:2010 by a notified CB will continue to use the PEFC Logo under the existing PEFC Logo Usage Licence Agreement signed with MTCC. Such use of the PEFC Logo will continue to be governed under the LG 2/2009.
  • However, once the existing PEFC Logo licence holder has been awarded a new certificate against the PEFC ST 2002:2010, the PEFC Logo licence holder will automatically be governed by the LG 3/2011 without having to sign a new Agreement, i.e. any reference made to the LG 2/2009 in the Agreement would then on be interpreted as reference made to the LG 3/2011.

2.   Holders of PEFC Certificate for Forest Management

  • FM certificate holders currently certified against the MC&I(2002) standard will have to  use the LG 3/2011 to apply for the PEFC Logo Usage Licence from MTCC.
  • FM Certificate holders who are also currently holders of the PEFC Logo licence will automatically be governed by the LG 3/2011 without having to sign a new Agreement with effect from 6 December 2011.

3.   PEFC-notified Certification Bodies

  • PEFC-notified CBs who are currently holders of the PEFC Logo licence will also automatically be governed by the LG 3/2011 without having to sign a new Agreement with effect from 6 December 2011.
